We join with those who mourn the loss of life,  the injuries, and the disruption of lives caused  by the attacks  against Washington,  DC, and  New York, N.Y.    All those effected -- the brave people who helped in rescue efforts, those involved in America's response to terror and in the war with Iraq-- are in our thoughts and prayers.

Chapter V:  Procedures



A.     GENERAL

No final personnel security determination shall be made on any person affiliated with DoD without granting the individual concerned the procedural benefits set forth in the DOHA when such determination results in an unfavorable administrative action.

B.     UNFAVORABLE ADMINISTRATIVE ACTIONS

No unfavorable administrative action shall be taken under the authority of the NISP unless the person concerned has been given:
     1.     A written statement of the reasons why the unfavorable administrative action is being taken.  The statement shall be comprehensive and detailed as much as the protection of sources afforded confidentiality under  the provisions of the Privacy Act of 1974, and National Security allow.
     2.     An opportunity to reply in writing.
     3.     A written response to any submission stating the final reasons, which shall be as specific as privacy and national security considerations allow.  Such response shall be as prompt as individual circumstances allow, not to exceed 60 days from the date of the receipt of the appeal submitted, provided no additional investigative action is necessary.
     4.     An opportunity to appeal to a higher level of authority designated by the office concerned.
